Heard learned counsel for the petitioner and learned Standing Counsel on behalf of the State respondents.

Considering the nature of the order proposed to be passed notices upon the private respondents is hereby dispensed with.

At the very outset, learned counsel for the petitioner submits that his Case No. 555 of 2022 (Computerized Case No. C 202213000000555) Smt. Hasmin Jahan and others vs. Ashraf Ali and others, under Section 24 (4) of U.P. Land Revenue Code, 2006, is pending since 2022, before the respondent No. 2 i.e. Commissioner Moradabad Mandal Moradabad, and the purpose of filing present writ petition shall stands served if the appropriate directions are issued to the respondent 2 i.e. Commissioner Moradabad Mandal Moradabad, to decide the case of the petitioner within the time frame fixed by this Court.

Learned counsel representing the respondents have no objection the aforesaid proposition.

Considering the fact that the Case of the petitioners is pending since 2022, this Court is also of the opinion that no useful purpose would be served by keeping the writ petition pending and the same is accordingly disposed of by requiring the respondent No. 2 i.e. Commissioner Moradabad Mandal Moradabad, seized with the Case No. 555 of 2022 (Computerized Case No. C 202213000000555) Smt. Hasmin Jahan and others vs. Ashraf Ali and others, to consider and decide the same expeditiously, preferably within a period of three months, from the date of production of certified copy of order of this Court, strictly in accordance with law.

Needless to say that this Court has not expressed any opinion on the merits of the case and it shall be open for the respondent No. 2 i.e. Commissioner Moradabad Mandal Moradabad to pass appropriate orders, strictly in accordance with law.
