Learned counsel for the petitioners is permitted to make necessary correction in the prayer clause of the writ petition during the course of the day.
Heard learned counsel for the petitioners, Shi Sudhir Bharti, learned counsel for respondent No. 5 and Shri Anand Bhaskar Srivastava, learned Standing Counsel for the State-respondents.
Considering the nature of the controversy involved in the present writ petition, the service of notice upon the private respondents are being dispensed with.
The limited prayer made by the petitioners in the present writ petition is for issuance of an appropriate direction to the Addl. Commissioner, (Administration), IIIrd Gorakhpur, respondent No. 2 to decide the Appeal No. 12/2011-2012, Computer Case No. C2012050000208 (Rampati versus Uma Shanker) within the time frame fixed by this Court.
It is contended by learned counsel for the petitioners that petitioners have filed the case in the year 2012 but till date the same has not been brought to its logical end.
Learned counsels appearing for the respondents submit that the case of the petitioner shall be decided by the respondents within the time frame fixed by this Court.
Considering the innocuous prayer made by the petitioners for expeditious disposal of the aforesaid case and also taking into consideration the fact that case of the petitioners is pending since long, the writ petition is disposed of by requiring the Addl. Commissioner, (Administration), IIIrd Gorakhpur, respondent No. 2 seized with the Appeal No. 12/2011-2012, Computer Case No.
C2012050000208 (Rampati versus Uma Shanker) to consider and decide the same expeditiously without giving any unnecessary adjournment to either of the parties within a period of three months from the date of service of certified copy of this order, strictly in accordance with law.
