Heard Sri Lalji Yadav, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

The present writ petition has been preferred for direction in the nature of mandamus to the respondents to consider and allot a house or monetary benefits in respect of house in favour of petitioner under Prime Minister Awas Yojana, (Gramin) (PMAY-G) out of permanent wait list2023..

On 11.07.2023 when the matter was taken up the Court this Court has passed following order:-

"The matter was taken up on 01.05.2023 and this Court has passed following order:-

"Grievance of the petitioner is that she was in the waiting list for the last five years for the benefit under the Prime Minister Awas Yojana (Gramin), however, village Pradhan is violating the priority list.

Learned Standing Counsel to seek instructions in the matter.

Put up this case on 22 May 2023, as fresh."

In response thereof, Shri S.C. Upadhyay, learned Standing Counsel placed the instructions dated 11.05.2023, which appears to be quite ambiguous and vague. We do not appreciate such intimation on behalf of State respondents.

Let the District Magistrate, Kushingar may go through in the matter and file his personal affidavit bringing forward distinct and clear facts so that the matter may be adjudicated.

Put up as fresh on 25.07.2023"

In response to the order dated 11.07.2023 the personal affidavit of the District Magistrate, Kushinagar has been filed today. The same is taken on record.

We have occasion to peruse the personal affidavit and find that in response to our order a three members committee was constituted on 22.07.2023 consisting the Project Director, District Rural Development Agency and Deputy Commissioner, Labour and Employment, Kushinagar and after due inquiry the report was submitted on 23.07.2023 wherein it is indicated that as per Clause 4.1 of the Prime Minister Awas Yojna Gramin, the claim of the petitioner is not sustainable.

Considering the affidavit and the inquiry report, we are not inclined to proceed further in the matter.

Accordingly, the writ petition is dismissed.
