Heard Sri Virendra Jaiswal, learned Counsel for the petitioner and Sri Punit Kumar Gupta, learned counsel for the respondent no.2.

The instant writ petition under Article 226 of the Constitution of India has been filed for direction in the nature of mandamus directing respondent no.1 to take appropriate decision on the petitioner's application dated 16.11.2022 filed under Section 41 of Waqf Act, 1995 seeking amendment in Waqf Register pertaining to Waqf No.501, Bijnor in compliance of judgement and decree dated 25.11.1993 passed in Case No.171 of 1993 (Abdul Wahid Khan Vs. U.P. Sunni Central Waqf Board) passed by the Waqf Tribunal, Bijnor within stipulated period.

In pith and substance, father of the petitioner filed a declaratory suit seeking a decree that 1-6-0 beegha land belongs to graveyard and rest 14 biswa land is his personal property. The aforesaid Suit was decreed vide judgement and decree dated 25.11.1993. Subsequently, the petitioner filed an application under Section 41 of Waqf Act seeking amendment in the Waqf Register pertaining to Waqf No.501, Bijnor, which is still pending.

Considering the facts and circumstances of the case, without adverting on merits and with the consent of the parties, the writ petition is disposed of with direction to the respondent no.1, U. P. Sunni Waqf Board to take a final call in the matter expeditiously, preferably within a period of two months from the date of production of a certified copy of this order but certainly after affording opportunity to all stakeholders.
