The case of the petitioners is that their land was acquired under the provisions of the National Highways Act, 1956. An award was passed by the competent authority under the provisions of the Act on 30.01.2020. The name of the petitioners duly finds place in Form No. 11, however, compensation amount have not been disbursed to them so far. The petitioners had represented to the Competent Authority on 06.10.2022, however, compensation still has not been paid to them and hence the instant petition praying for a writ of mandamus commanding respondent no. 3 to pay compensation to the petitioners and decide their representation dated 06.10.2022.

Sri Anurag Yadav, learned counsel appearing for respondent no. 2, Ms. Kiran Bala, learned counsel appearing for Union of India and Sri Rajiv Gupta, learned Additional Chief Standing Counsel for State respondent submit that the issue can be examined by the Competent Authority.

Accordingly, we dispose of the petition with a direction to respondent no. 3 to examine the claim of the petitioners in context of their representation dated 06.10.2022 and pay compensation to

them within 12 weeks from the date of communication of the instant order. In case, he is of the view that compensation is not payable to any of the petitioners, he shall pass a speaking order within said period.
