Heard learned Counsel for the petitioner, learned Standing Counsel for Respondents No.1,2 and 4 as well as Sri Ashok Kumar Singh and Sri Awadhesh Kumar, learned counsel appearing for Respondents No. 3, 5 and 6.

Learned Counsel for the petitioner has submitted that the petitioner presently is working on the post of Headmaster in Uchch Prathmik Vidyalay, Baghaura, Block Kaptanganj, District Basti.

Learned Counsel for the petitioner has further submitted that on some medical issues, petitioner is facing acute difficulties and, therefore, he has submitted an application on 1.5.2023 before the District Basic Education Officer, Basti praying therein to consider his request for voluntary retirement.

Learned Counsel for the petitioner has argued that though the aforesaid application was filed on 1.5.2023 but till date the District Basic Education Officer, Basti has not taken any steps in respect of the voluntary retirement of the petitioner. It has been further argued that since petitioner is facing acute medical issues, therefore, it is in the fitness of the things that his application for voluntary retirement be considered by the District Basic Education Officer, Basti at the earliest.

I have heard learned counsel for the petitioner and learned counsels appearing for the respondents and I find that the application of the petitioner for voluntary retirement is pending before the District Basic Education Officer, Basti since 1.5.2023.

In view of the aforesaid, this Writ Petition is finally disposed of with a direction to the District Basic Education Officer, Basti to consider and decide the pending application of the petitioner dated 1.5.2023, within a period of two months from the date of presentation of certified copy of this order.
