(1) Heard Sri S.B.Panday, learned Deputy Solicitor General of India, assisted by Sri Varun Pandey, learned counsel for the petitioners.
(2) It is fairly pointed out by Sri S.B.Pandey, learned Deputy Solicitor General of India appearing for the petitioners that the subject matter of the present writ petition is squarely covered under the judgment rendered by a coordinate Bench of this Court in a bunch of writ petitions, leading writ petition being Writ-A No. 49864 of 2017, decided on 30.04.2018.
(3) Relying on the judgment dated 30.04.2018 passed in the aforesaid bunch of writ petitions, a Co-ordinate Bench of this Court at Allahabad dismissed Writ-A No. 9235 of 2021 vide order dated 25.08.2021. Against this order, the Union of India approached the Apex Court through SLP (C) No.6549 of 2022(Union of India and others v. Vijay Kumar and another), which was also dismissed vide order dated 06.05.2022.
Coordinate Bench of this Court in a bunch of writ petitions, leading writ petition being Writ-A No. 49864 of 2017. The liberty left open to the department, if any, under the judgment dated 30.04.2018, shall be available to the Government at par.
