Heard Shri Vijai Kumar Tiwari, learned counsel for the petitioner, learned Standing Counsel for State-respondent and Shri Mahesh Narayan Mishra, learned counsel for respondent No. 4.

The order under challenge in this writ petition is to an order dated 29.11.2022 passed by the respondent No. 4, Chairman, Administrative Committee, Multipurpose/Co-operative Society Ltd., District Bareilly whereby the services of the petitioner have been terminated.

At the very out set, Shri Mahesh Narayan Mishra, learned counsel for the respondent submits that the petitioner has an alternative remedy of approaching before the Registrar, Cooperative Societies under Section 128 of the U.P. Co-operative Societies Act, 1965.

Confronted with the aforesaid, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition with liberty to avail the remedy as provided under Section 128 of the U.P. Co-operative Societies Act, 1965.

In view of the availability of efficacious alternate remedy under Section 128 of the U.P. Co-operative Societies Act, 1965, the writ petition is dismissed as withdrawn, with liberty to the petitioner to invoke the provisions of Section 128 of the U.P. Co-operative Societies Act, 1965.
