Heard learned counsel for the parties and perused the record.

This Court on 2.5.2023 has passed the following orders:-

"Heard Sri Brij Raj Singh, learned counsel for the petitioner, Sri Devendra Pratap Singh, learned counsel, who has accepted notice on behalf of respondent no.2 and learned Standing Counsel representing respondents no. 1,3 and 4.

The petitioner, who claims to have superannuated on the post of Incharge, Branch Manager, Cooperative Bank, Jagnipur, Ghazipur, has approached this Court being aggrieved by the action of the respondents in not concluding the departmental disciplinary inquiry against him and placing him under suspension vide order dated 24.01.2018.

It is contended by the learned counsel for the petitioner that despite passing of nearly five years the inquiry proceedings initiated against the petitioner have not been brought to its logical end and the petitioner continues to be placed under suspension. He also submits that after his superannuation he has not been released any of his retiral dues on account of pendency of proceedings.

On specific quarry being made from the respondents Sri D.P. Singh, learned counsel for the representing respondent submits that he shall seek instructions in the matter within a period of ten days and apprise the Court as to why proceedings have been kept pending against the petitioner.

List this case on 12th May, 2023 as fresh."

When the matter was taken up today, learned counsel for respondent No. 2 has produced a letter dated 10.5.2023, which has been taken on record, indicating the fact that the inquiry has been completed and inquiry report has been submitted before the disciplinary authority for further action.

Be that as it may, the writ petition is disposed of with the direction upon the respondent No. 2 to take decision on the inquiry report within four weeks from the date of production of certified copy of this order. Needless to say that decision on the inquiry report shall be taken strictly, in accordance with law.

The writ petition is disposed of .
