Heard Shri Vipin Chandra Pal, learned counsel for the petitioner and Shri Shresth Pratap Singh under the authority of Mrs. Archana Singh, learned counsel for the respondent No. 2. Learned Standing Counsel has accepted notices on behalf of respondent No. 1.

The present writ petition has been filed seeking issuance of a writ of mandamus commanding the respondent No. 2 to allocate the District Prayagraj to the petitioner which was her first preference in her application form regarding recruitment in question for the post of Assistant Teacher (Primary School) run and managed by the U.P. Board of Basic Education at Prayagraj and provide him posting accordingly with the consequential seniority which she attain during the course of her working at District Sitapur on the said post.

At the very out set, Shri Shresth Pratap Singh, learned counsel for respondent No. 2 submits that the issue involved in this writ petition and the grievance raised herein have already been decided by a decision dated 13.3.2023 by Lucknow Bench in Writ-A No. 13156 of 2020 (Mahendra Pal and others versus State of U.P. through Addl. Chief Secretary, Department of Basic Education and others) .

Shri Vipin Chandra Pal, learned counsel for the petitioner submits that the petitioner has already preferred several applications, lastly on 9.7.2021 and the grievances raised therein may also be considered by the authority in the light of the decision rendered in Writ-A No. 13156 of 2020.

Shri Shresth Pratap Singh, learned counsel for respondent No. 2 has no objection to the aforesaid proposition.

This Court is also of the opinion that the writ petition can be disposed of by directing the respondent No. 2, Secretary, Basic Education Board, Prayagraj to pass appropriate orders on the

pending representation of the petitioner considering all aspect of the matter including the decision rendered by the co-ordinate Bench of this Court in Writ-A No. 13156 of 2020, expeditiously preferably within a period of three months from the date of production of certified copy of this order.

The writ petition is accordingly disposed of .
