Heard learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.

The petitioner has approached this Court with the grievance that the petitioner and her husband both were working in the District Hospital at Urai. However, by means of the transfer order dated 31.06.2022, the petitioner being wife has been transferred to District Hospital Kanpur Nagar.

It is further submitted that the petitioner has already raised the issue by moving the representation with the respondent no.2, a copy of which has been brought on record as annexure no.4. However, the same has not been decided till date.

Considering the fact that the issue regarding transfer is already pending before the respondent no.2, accordingly at this stage, the Court is not inclined to call for a counter-affidavit or keep the matter pending rather is of the opinion that ends of justice can be met by directing the respondent no.2 to consider and decide pending representation of the petitioner and take decision thereon within a period of six weeks from the date a copy of this order is placed before the Authority concerned and intimate the same to the petitioner.

It is made clear that the Court has not examined the case of the petitioner on merits and the Authority concerned shall decide the same strictly in accordance with applicable rules and law.

With the aforesaid, the petition stands disposed of.
