The petitioner who is working as police constable in civil police has prayed for monetary benefit in terms of pay for the period, he has been under suspension on account of involvement in a criminal case. He submits that no disciplinary proceeding at any point of time was initiated against the petitioner in criminal case in which he was falsely implicated and he has been finally acquitted by the Additional Sessions Judge, Court No. 1, Ballia under the judgment and order dated 24th January, 2023 in Sessions Trial No. 91 of 2015. He, therefore, submits that he is entitled for full pay/salary for the period he was placed under suspension.

It is submitted that in the above regard, he has already approached the Superintendent of Police, Jalaun vide representation dated 3rd March, 2023, however, monetary benefit to which petitioner is entitled including ACP benefits has not been paid.

Learned Standing Counsel does not have any objection to the above request of the petitioner for disposal of representation by the competent authority in the matter, in accordance with law.

In view of above, this writ petition stands disposed of with direction to the Superintendent of Police, Jalaun, to look into and consider the representation of the petitioner dated 3rd Mach, 2023 and dispose of the same in accordance with law within a period of two months from the date of presentation of certified copy of this order by means of reasoned and speaking order.
