Heard learned counsel for the parties.

Petitioner who is seeking promotion as Sub Divisional Magistrate from the post of Tehsildar is aggrieved for not being accorded consideration for promotion only on account of uncommunicated adverse entry for the year 2012-13. He submits that broad-sheet could not have carried such adverse entry which was uncommunicated to the petitioner as the petitioner had no opportunity to represent against the same and, therefore, this adverse entry could not be given consideration while considering the benefit of promotion.

Learned counsel for the petitioner submits that in above regard, petitioner has already made application before the competent authority namely Commissioner and Secretary, Board of Revenue, UP Lucknow on 24.02.2021 and subsequent to that his reminders filed thereof as latest as on 18.08.2023.

Learned Standing Counsel does not have any objection to the petitioner's representation made latest on 18.05.2023 and 18.08.2023 are directed to be disposed of in accordance with law.

In view of the above, this petition stands disposed of with the direction to the respondents to look into and consider the grievance of the petitioner and pass appropriate orders upon his representation regarding his uncommunicated adverse entries and dispose of the same, as expeditiously as possible, preferably within a period of two months from the date of presentation of certified copy of this order by means of a reasoned and speaking order.
