Heard learned counsel for the petitioner as well as learned Standing Counsel.

Petitioner who is seeking promotion from the post of Senior Assistant to Head Assistant has come up before this Court with the prayer that the sealed envelope may be permitted to be opened in the light of provisions contained under the Government Order dated 28.05.1997 read with 09.01.2018.

It is argued by learned Senior Advocate appearing for the petitioner that the sealed cover procedure was adopted in the matter of petitioner on 05.02.2021 on account of pending criminal case in connection with case crime no. 400 of 2020 instituted in the year 2020 which is pending since the year 2020. It is submitted petitioner in any circumstances is not responsible for the delayed criminal proceedings and therefore, his representation is liable to be considered in the light of provisions as contained in para 10 of the Government Order ( supra ). Para 10 of the Government Order is reproduced hereunder:

( ज ) तदथरआधदरपरपरनतआररमपतकदममरककनमवरदचलरहबपशदसनदलधकरणकक जजच / मवभदगबयकदयरवदहबअमभयरजनआमदकनअननतमपररणदमपदपहरजदननपरउसकन मवरयममउसबपकदरअमगमकदयरवदहबककजदयनगब , जहसबककजदतबहबयमदउसनतदथरपरनमत नदबगयबहरतब।

( झ ) यमदनयदयदलयददरदमकसबतदथररपसनपरनतकदममरककरतकनबककआधदरपर ( गमणदवगमणकनआधदरपरनहब ) दररममकमकयदजदतदहहऔरनयदयदलयकनमनणरयकनमवरद अपबलयदउसबआररपकनललएमवभदगबयकदयरवदहबकदपसतदवहहतरउसदशदममसमक पदलधकदरबइसमबनदमपरमवचदरकरनगममकआररमपतकदममरककरतदथरपरनमतपरबनदयनरखद जदयअथवदनहह। "

Learned counsel for the petitioner submits that in the above regard, petitioner has already approached the authority on 03.08.2023 by making a representation, copy whereof has been brought as Annexure No.5 to the writ petition.

Learned Standing Counsel submits that the matter can be directed to be examined in the light of provisions as contained in para 10 of the Government Order by the competent authority in the matter which has been represented with.

In view of the above, this petition stands disposed of with a direction to the competent authority to look into and consider the representation of the petitioner in the light of provisions as contained in para 10 of the Government Order and pass appropriate, reasoned and speaking order within a period of two months of presentation of certified copy of this order. It is further provided that in the event respondents comes to conclude that the petitioner is entitled to benefit of reopening of the sealed envelop,

the same shall be reopen and petitioner be offered ad hoc appointment subject to the conclusion of trial and be paid salary accordingly.
