A compliance affidavit has been filed on behalf of the Director, Directorate of Local Bodies, U.P., Lucknow, which is a personal affidavit of the Officer, in Court today. The said affidavit is taken on record. Let it be numbered by the office. In paragraph nos. 7 and 8 of the said affidavit, it is averred:

"7. That vide letter No. PC/4421/454/Pe/93/PPO-23/2501, dated December 11, 2023 of Directorate to the Branch Manager State Bank of India, Main Branch Rampur regarding the recovery of Additional Family Pension which was deposited in the account bearing pension account no. 10986825969 of Mother of petitioner i.e. late Suraiya Begam wife of Masood Ul Hasan Khan who died on 19.04.2023 and further stated that the said amount shall be deposited Uttar Pradesh Municipal (Centralized) Service Employees Pension Fund, bearing account number-10143755284, and to inform such to the Directorate. A copy of the letter dated 11.12.2023 is being filed herewith and marked as Annexure No. 1 to this affidavit.

That in view of the above facts, by the Directorate's letter No. PC/12266/454/Pen/93/PPO-23/2501, dated December 11, 2023. The petitioner Ms. Mobina Masood, unmarried daughter of Late Masood Ul Hasan Khan family pension payment order of has been issued. A copy of the letter No. PC/12266/454/Pen/93/PPO- 23/2501, dated 11.12.2023 is being filed herewith and marked as Annexure No. 2 to this affidavit."

A perusal of Annexure No. 2 annexed to the compliance affidavit shows that a Pension Payment Order dated 11.12.2023 has been issued sanctioning payment of family pension to the petitioner in the sum of Rs. 9,000/- per month plus dearness relief.

In the circumstances, it is directed that arrears of family pension that had earlier been credited to the account of the petitioner's deceased mother mentioned in paragraph no. 7 of the affidavit shall now be withdrawn and credited to the petitioner's account within a week. Regular family pension shall be paid to the

petitioner, month by month, in accordance with the family pension order no. PC/12266/454/Pen/93/PPO-23/2501 dated 11.12.2023 in the petitioner's account.

This petition is allowed in terms of the aforesaid orders
