Heard Sri Narendra Mohan, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State respondents and Sri Pradeep Singh, learned counsel for the respondent-Gram Sabha.
The present petition has been filed as a public interest litigation seeking to raise a grievance with regard to alleged illegal encroachments over land bearing Arazi No.123 measuring area 0.759 hectare situate in Village- Kathari, Tehsil- Aurai, DistrictBhadohi, which is stated to be recorded as Gram Sabha land.
Counsel for the respondent-Gram Sabha points out that in respect of the same land, earlier a writ petition being Public Interest Litigation No. 1851 of 2022 (Durga Prasad Dubey vs. State of U.P. And 4 Others) had been preferred, which was finally disposed of in terms of an order dated 30.09.2022.
Upon being confronted with the aforestated factual position, counsel for the petitioner fairly states that he does not wish to press the petition.
The petition stands disposed of accordingly.
