Shri Ajay Mishra, learned counsel for the applicants and Shri Moti Lal, learned A.G.A. for the State are present.
Present Transfer Application has been filed to transfer the Complaint Case No. 908/9/2021, Smt. Meera Devi Vs, Amar Singh and others, under Sections 494, 495, 497, IPC, Police Station Kotwali Nagar, District Banda, pending in the court of Civil (Junior Division)/Fast Track Court, Banda to any other competent court of adjoining District.
Learned counsel for the applicants submits that the applicants are accused in the above noted case. It is further submitted that the applicants are residing in District Kanpur Nagar. The court is 13 Km. away from the residence of the applicants.
It is further submitted that on 8.8.2023, opposite party No. 2 started abusing and threatening the applicant No. 1 to lodge more false and frivolous case against him and threatened with dire consequences. The applicants filed a complaint before the Superintendent of Police, Banda. It is further submitted that the applicants have not attempted to lodge the first information report in the police station.
In view of the above facts and circumstances, the Transfer Application has no merit and deserves to be dismissed.
The instant application is dismissed accordingly.
