Learned counsel for the petitioner submitted that Rahisu is one of the detenues, who are held in captive in brickkiln named as BrickKiln Marka V.K.F. situated at village Dagarpur, P.S. Tehsil Khekra, District Baghpat. The said brickkiln is operated by respondent nos. 5 to 8. The petitioner joined the job of labour at said brickkiln along with detenues. The rate of molding was fixed between petitioner detenue on the one hand and respondent nos. 5 to 8 on the other hand but subsequently respondent nos. 5 to 8 refused to pay the arrears of wages and started misbehaving with the petitioner and other detenues and harassed them with the help of hired musclemen. They did not pay any advance to the detenues or any other essential amenities to children of detenues. Petitioner, anyhow, rescued from the captive of private respondents and informed the concerned District Magistrate and S.P., Bahgpat with prayer to release the detenues who are held in captive as bonded labourers by private respondents, on 5.1.2023 but no effective action was taken against private respondents and they are held captive in said brickkiln in violation of law. A copy of the representation made to District Magistrate and S.P. concerned has been filed as Annexure-2 to the writ petition. It is further submitted that if this Court thinks proper, present petition may be disposed of finally by issuing necessary directions to the Authorities to carry out the task of rescue of detenues from said brickkiln and suitable action may be taken against private respondents.
