Heard learned counsel for the petitioner as well as learned A.G.A. for the State.
The petitioner herein has filed the present criminal writ petition seeking following relief:-
"Issue a writ order or direction in the nature of mandamus commanding the respondent No. 5-Commissioner, Kanpur Division, Kanpur to decide the stay application of the petitioner and to decide the appeal No. 2454 of 2022, State Vs. Vijay Singh, within a period of three weeks or any other specific period as this Hon'ble Court may deem fit and proper on the facts and circumstances of the case."
Leaned counsel for the petitioner has confined his submission with regard to disposal of the appeal which is stated to be pending before respondent No. 5 - Commissioner, Kanpur Division, Kanpur, within stipulated time.
Learned A.G.A. has no objection for expeditious disposal of the pending appeal.
In view of the categorical submissions made by learned counsel for the parties, the present writ petition is finally disposed of with the direction to respondent No. 5-Commissioner, Kanpur Division, Kanpur, to decide the appeal which is stated to be pending being Appeal No. 2454 of 2022, State Vs. Vijay Singh within two weeks from the date of production of a certified copy of this order, subject to any legal impediment and cooperation of the parties.
