The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 16.3.1990 passed by IX Addl. District and Sessions Judge, Allahabad in S.T. No.130 of 1988.
As per the office report dated 25.2.2023, a report of C.J.M., Allahabad dated 30.1.2023 has been received stating therein that the sole appellant Babu Lal has died. The said report has been sent after due inquiry.
This Court has perused the said report which states that the accused-appellant Babu Lal has died around eight years back.
In view of the above, the appeal stands abated.
