The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 3.5.1986 passed by Addl./Special Judge IV, Etawah in Special Case No.129 of 1986.
As per the office report dated 28.2.2023, a report of C.J.M., Auraiya dated 1.12.2021 has been received stating therein that the sole appellant Ashiq Ali has died around 25 years back. The said report has been sent after due inquiry.
This Court has perused the said report which states that the accused-appellant has died around 25 years back.
In view of the above, the appeal stands abated.
File consigned to records.
