This appeal has been preferred by the accused-appellant Anand who has been convicted in Session Trial No.865 of 2005 (State Vs. Anand) and sentenced the appellant under Section 304/34 I.P.C. for seven years along with fine of Rs.5,000/-, under Sections 376 & 511/34 I.P.C. for five years rigorous imprisonment along with fine Rs.2,000/- and under Section 201 I.P.C. for one year imprisonment, in default of payment of fine one year additional imprisonment. All the sentences will run concurrently.
A report has been submitted by the Chief Judicial Magistrate, Muzaffarnagar, as per which, the accused-appellant Anand has already died on 23.01.2011. Death certificate of accused-appellant is also annexed.
In view of the fact that accused-appellant has already died, the present appeal abates and is, accordingly, dismissed .
