Heard Shri Sandeep Kumar Dubey, learned Amicus Curiae and learned A.G.A. Perused the record.

The appellant was condemned and convicted vide judgment and order dated 25.7.2009 passed by the Additional Sessions Judge, Court No.2, Muzaffar Nagar while deciding Session Trial No.1148 of 1997 (State vs. Rajveer and another) and Session Trial No.1137 of 1999 (State vs. Ramveer Singh), arising out of Case Crime No.75 of 1997, whereby the appellant Ramveer was convicted and awarded sentence u/s 148 I.P.C. for two years rigorous imprisonment and u/s 302 I.P.C. read with Section 149 I.P.C. for life imprisonment.

Learned counsel for appellant submits that the connected appeals have stood abated on account of demise of other co-accused persons. So far as the present appellant Ramveer is concerned, he is released from jail on remission by the State Government vide order dated 25th May, 2023 keeping in view his good conduct in the jail.

Since the appellant has already been released from jail on remission by the State Government, there is no ground to keep this appeal alive and pending. Accordingly, the present appeal is disposed of and consigned to record.

Impugned judgment is modified to the period already undergone and thereafter remitted by the State Government under the Scheme of remission.

A remuneration of Rs.15,000/- be paid to Shri Sandeep Kumar Dubey, learned Amicus Curiae by the High Court Legal Services Committee by three months.
