The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 8.1.1987 passed by Addl. Sessions Judge, Fatehpur in S.T. No.533 of 1983.
As per the office report dated 18.3.2023, a report of C.J.M., concerned dated 22.2.2022 has been received stating therein that the sole appellant Kailash Narain has died on 3.6.2018. The said report has been sent after due inquiry.
This Court has perused the said report which states that the accused-appellant has died on 3.6.2018.
In view of the above, the appeal stands abated.
