Mr. Harish Chandra Mishra, learned counsel for the applicant, learned A.G.A. for the State and Ms. Beena Mishra, learned counsel for opposite party nos. 3 and 4 are present.
By means of this application under Section 439 of Cr.P.C., applicant Ravendra, who is involved in Case Crime No. 16 of 2020, under Section 376 IPC and Section 3/4 POCSO Act, police station Allahganj, district Shahjahanpur, seeks enlargement on bail during the pendency of trial.
On the matter being taken up, Mr. Harish Chandra Mishra, learned counsel for the applicant submits that district of the present case has been wrongly transcribed in the bail application as Saharanpur in place of Shahjahanpur. The details of rejection of first bail application of the applicant is not mentioned. He is also not aware about present status of trial of the applicant. He prays for withdrawal of the instant bail application with liberty to file fresh bail application with complete facts and better particulars.
In view of the statement made by Mr. Harish Chandra Mishra, learned counsel for the applicant at the bar, the instant bail application is dismissed as withdrawn with liberty as prayed for.
