1 . Heard learned counsel for the applicant, learned AGA and perused the record.
2 . It is argued by the learned counsel for the applicant is that one of the co-accused from whom similar recovery was allegedly effected in the same FIR had been enlarged on bail. Bail order of the co-accused is on record as annexure no.3 to the bail application. The applicant is in custody since 21.04.2023. The applicant is entitled to be released on the ground of parity.
3. Learned A.G.A. vehemently opposed the bail prayer.
4. Considering the fact that one of the co-accused has been enlarged on bail and the applicant has no criminal antecedents and the allegations are similar in nature. The applicant is in custody since 21.04.2023, I am of the view that the applicant is entitled to be released on bail on the ground of parity.
