It has been argued by the learned counsel for the applicant that applicant is innocent and has been falsely implicated in this case. It is further submitted that the incident was alleged to be occurred on 23.05.2021 at 10:30 P.M. and the first information report was lodged against the applicant and the other co-accused under Sections 323, 504, 506 I.P.C. The applicant had earlier applied for bail under Sections 323, 504 and 506 I.P.C. before A.C.J.M., Court No. 9, Allahabad and vide order dated 06.08.2021, the court concerned has granted bail to the applicant. The Investigating Officer after investigation had submitted charge sheet against the applicant under Sections 323, 504, 506, 325, 308 I.P.C. The applicant had already enlarged on bail under Section 323, 504 and 506 I.P.C., and had applied for anticipatory bail under added Sections 325, 308 I.P.C. The applicant has an apprehension that he may be arrested in the above-mentioned case, whereas there is no credible evidence against him. The applicant has no criminal antecedents and that no coercive process has been issued against the applicant so far. It is submitted that applicant undertakes to cooperate during trial. It has been stated that in case, the applicant is granted anticipatory bail, he shall not misuse the liberty of bail and would obey all conditions of bail.
