present case was lodged by Ranjeet, father of the victim, on 20.2.2021 wherein he has stated that his minor daughter had gone to school on 17.2.2021 and when she was returning home, accused Vicky, Arjun and Ramnivas met her on way riding motor-cycle and forcefully abducted her by sitting her on motor-cycle. He apprehended that she may be killed or sold in flesh-trade market by accused Vicky and Arjun. He next submitted that as per prosecution case the victim came back to home on 21.2.2021 herself and investigating officer recorded her statement under Section 161 Cr.P.C. in which she implicated the accused Vicky, Gaurav and Sujeet who had abducted and misbehaved with her and confined her in a room at Golden Dhaba. She anyhow got herself rescued. He next submitted that in medico legal examination report, no internal or external injury was found on her person, however her hymen was found ruptured at 6 O' clock position, redness was present and abrasion was also found present on vestibule. She also stated that all the three persons made physical relations with her forcefully in her statement under Section 161 Cr.P.C. and 164 Cr.P.C. In medico legal examination her age was fund was 18 years. In her high-school mark-sheet, her date of birth is mentioned as 2.2.2023 and accordingly she attained the age of majority on the date of incident. It is further submitted that victim and informant have been examined during trial as PW-1 and PW-2, in which informant had stated that he had not seen the incident. His daughter had not told him that accused persons had abducted her forcefully by making her sit on their motor-cycle. He came to know that his daughter left the home on 17.2.2021 and went to the place of her aunt (mausi) at Dohrighat as she was rebuked on account of some domestic work and came back to home after being persuaded by her mausi. She had also not told him that accused committed any wrong act with her. Victim has also stated as PW-2 that she is student of B.Sc.. On 19.2.2021 she was rebuked by her mother due to some causes relating to study and went for school at 10:00 am and thereafter she took leave from the school and went to the place of her mausi at Dohrighat where she stayed for four to five days. When she came back to home, she was astonished to know that her father had got a case registered in relation to her at the behest of some other persons. Accused persons Gaurav, Sujeet and Vicky, have not abducted and did not do anything wrong with her or rape with her. They also not abused or insulted her. She also disowned her statement under Section 161 Cr.P.C. recorded by the investigating officer and statement under Section 164 Cr.P.C. recorded by the magistrate, however, in crossexamination she admitted that she was acquainted with accused persons as they belonged to her village.
