This Application under Section 483 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to hear and decide the Case No. 275 of 2019 in Case Crime no. 673 of 2019, under Sections 328, 376D, 384, 506 IPC and 5/6 POCSO Act, P.S. Modi Nagar, District Ghaziabad expeditiously within stipulated time.
Learned counsel for the applicant states that certified copy of the ordersheet of the case is filed; case is fixed for cross examination of PW-2; evidence of PW-1 has been recorded, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of one year from the date of production of certified copy of the order, without permitting undue adjournments to either side, if there is no legal impediment and the applicant shall co-operate with trial of the case.
With this direction, this application is disposed of.
