Heard Sri Majahar Ali, learned counsel for the applicant, Sri Raj Kumar Gupta, learned counsel for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant Harish Kumar Alias Shankar Lal, with the prayer to quash the summoning order dated 9.3.2017 passed by Additional Chief Judicial Magistrate, Court No. 1, Bareilly in Complaint Case No. 1641 of 2015 (New Complaint Case No. 876 of 2018), under Sections 323, 392 I.P.C., P.S.- Baradri, District Bareilly, pending before the Additional Chief Judicial Magistrate, Court No. 1, Bareilly and with the further prayer to stay the further proceedings of the said case.
After some arguments, learned counsel for the applicant states that he shall be raising all the objections available to them before the trial court at the appropriate stage for which the trial court may be directed to consider the same.
It is needless to state that the applicant can always take up their case and raise objections at the appropriate stage of trial which may be considered by the trial court at the appropriate stage.
The present application is disposed of.
