The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 25.5.1984 passed in S.T. No. 291 of 1982.
As per the office report dated 1.2.2023, a report of C.J.M., Fatehpur dated 22.2.2022 has been received stating therein that the sole appellant Heera Lal has died around five years back. The said report has been sent after due inquiry.
This Court has perused the said report which states that the accused-appellant has died around five years back.
In view of the above, the appeal stands abated.
