Heard learned counsel for the applicants and learned A.G.A for the State-respondent.
The applicant has preferred the present Application under Section 482 of Code of Criminal Procedure, 1973 for quashing the impugned charge sheet dated 13.6.2022 and the entire proceedings of Criminal Case No.1339 of 2022 (State Vs. Veeram Singh and others) arising out of Case Crime No.57 of 2022, under Sections 323, 324, 308, 504, 506 IPC, P.S. Aliganj, District Bareilly pending in the court of Judicial Magistrate-II, Aonly, District Bareilly.
After some arguments, learned counsel for the applicant prays that the applicant be permitted to move appropriate application before the Court concerned as provided under Section 227 of the Cr.P.C.
This prayer has not been opposed by the learned A.G.A.
Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court through counsel within 15 days from today and move an application under Section 227 of Cr.P.C. claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously.
For a period of 30 days, no coercive action will be taken against the applicant.
With the above observations, this application stands disposed of.
