By way of the instant applicant, the applicant has sought for quashment of the impugned order dated 27.4.2022 passed by Sub Divisional Magistrate Sadar, Farrukhabad, in Case No. 12943 of 2019, Computerized Case No. T201903240112943 (State Vs. Munna Lal and Others) under Section 145 Cr.P.C.
At the very outset, learned counsel for the applicant has submitted that the applicant relinquishes the prayer for quashment and submitted that a direction may issued to decide the recall application moved before the Court below to recall the aforesaid order, as expeditiously as possible.
Learned A.G.A. has no objection.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
In this view of the matter, this application is disposed of with the direction that the court below will expedite and dispose of the recall application dated 14.11.2022 filed in the aforesaid case, in accordance with law expeditiously preferably within a period of three months from the date of production of a certified copy of this order before it after affording opportunity of hearing to the parties concerned, if there is no legal impediment.
