Heard Sri Abhishek Mishra, learned counsel for the applicant and Sri B.B. Upadhyay, learned counsel for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant Prem Chandra Patel with the prayer to allow the present application and quash/set-aside the summoning order dated 21.11.2006 passed by the Chief Judicial Magistrate, Lalitpur and the notice of summon served to the applicant vide dated 17.09.2022 as well as quashing of the entire criminal proceedings in Criminal Case No. 3939 of 2006 (Durga Narayan Vs. Rajendra Prasad) as Case Crime No. 05 of 2005, under Sections 384, 406 IPC, registered at Police Station Kotwali, District Lalitpur, pending before the court of Chief Judicial Magistrate, Lalitpur and with a further prayer to stay the further proceedings in the said case, during the pendency of the present application.
After arguments at length, learned counsel for the applicant states that the present application under Section 482 Cr.P.C. be dismissed as withdrawn as he intends to file a better petition.
Prayer is allowed.
The present application is dismissed as withdrawn.
