Heard Sri Bipin Kumar Tripathi, learned counsels for the applicant and Sri B.B. Upadhyay, learned counsel for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant Deepankar Pandey with the prayer to allow the present application and quash the entire proceeding in Case No. 1921 of 2022 'Complaint Case No. 492/2021' (Smt. Shamsi Shakeel Vs. Deepankar Pandey), under Section 138 Negotiable Instrument Act, pending in the court of Additional Chief Judicial Magistrate-II, Amorha pursuant to impugned summoning order dated 26.07.2021 as well as impugned order dated 04.06.2022 issuance of non bailable warrant passed by the courts below and with a further prayer to stay the further proceedings in the aforesaid case, during the pendency of the present application.
After arguments at length, learned counsel for the applicant states that the present application under Section 482 Cr.P.C. be dismissed as withdrawn as he intends to file a better petition.
Prayer is allowed.
The present application is dismissed as withdrawn.
Certified copies, if any, be returned as per rules.
