The present application under Section 482 Cr.P.C. has been filed by the applicants-Jeeviteshwar Kamlesh Anagh @ Kamlesh Kumar and Smt. Amravati with the prayer to quash the summoning order dated 3.5.2018 as well as entire proceeding in Criminal Case No.2095 of 2018 arising out of Case Crime No.342 of 2017, u/s 323, 504, 506 IPC, P.S. Sarai Akil, District Kaushambi pending before Judicial Magistrate, Kaushambi and further to stay the further proceedings of aforesaid case during the pendency of the present application.
Learned counsel for the applicants after some arguments states that the applicants are already on bail and present application U/s 482 Cr.P.C. be dismissed as withdrawn as the applicant intends to raise all the objections available to him during trial.
Prayer as prayed is allowed.
The present application U/s 482 Cr.P.C. is dismissed as withdrawn with the aforesaid liberty.
