Heard learned counsel for the applicant and learned A.G.A. for the State of U.P.
At the outset, learned counsel for the applicant submits that though no charge-sheet has been submitted against the applicant under Section 3(1) (X) of SC/ST Act but due to typographical mistake, the same has wrongly been transcribed in the prayer clause, therefore, he does not want to press this application as such the same may be dismissed as withdrawn with liberty to file fresh application.
Learned A.G.A. has no objection to such prayer.
In view of the statement made by learned counsel for the applicant at the Bar, the instant application is dismissed as withdrawn with the liberty as prayed for.
OfÏce is directed to return the certified copy of the document to the counsel for the applicant within three days after retaining the xerox copy of the same on record.
