1-Heard Mr. Irshad Ahmad, learned counsel for the applicants, learned A.G.A. for the State and learned counsel for opposite party no.2.
2-This application under Section 482 Cr.P.C. has been filed by the applicants with prayer to quash the order dated 13.06.2023 passed by Sessions Judge, Baghpat in Criminal Revision No. 186 of 2023 (Sonu @ Shadab and others Vs. Smt. Imarana and others) arising out of order dated 06.08.2022 alongwith proceedings of Complaint Case No. 377 of 2022 (Smt. Imarana Versus Sonu alias Shadab and others) summoned the applicants under Sections 498-A, 323 I.P.C. and Section 3/4 Dowry Prohibition Act, pending in the court of Civil Judge (Junior Division)-F.T.C., Baghpat.
3-At the outset learned counsel for opposite party no.2 pointed out that wrong fact has been mentioned in paragraph no.11 of the afÏdavit that the applicant has qualified Provincial Civil Services Examination and has become P.C.S. OfÏcer in the year 2014, whereas he is a painter.
4-In response, learned counsel for the applicants submits that due to cut and paste, this error has been occurred in the application. He further submits that the applicants do not want to press this application on account of such defect and therefore, they may be allowed to withdraw this application with liberty to file fresh application with better particulars.
5-Learned A.G.A. for the State as well as learned
counsel for opposite party no.2 have no objection to such prayer of the applicants.
6-In view of the above, the instant application is dismissed as not pressed with aforesaid liberty.
7-OfÏce is directed to return certified copy of this order to the counsel for the applicants within a week after retaining xerox copy of the same on record.
