- Heard learned counsel for the petitioner, learned A.G.A. for the State-respondent.
- By means of this application, the only prayer made by the applicant is that direction may be issued to the Judicial Magistrate, Budana, Muzaffar Nagar to decide/expedite the proceedings of the Case No. 629 of 2021 (State Vs. Sunny), arising out of Case Crime No. 48 of 2021 under Sections 323, 452, 506, 354 (Kha), 504 IPC, Police Station Phugana, District Muzaffar Nagar.
- Vide order dated 09.05.2023, a report was called from the Judicial Magistrate, Budana to submit status of the proceedings. In compliance of the said order, the Civil Judge, Budana had sent a report on 16.05.2023, which is taken on record. From the report, it seems that the counsel for the accused had taken adjournment and the same was easily granted.
- Considering the facts of the case and without expressing any opinion on the merit of the applicant's case, this application under Section 482 Cr.P.C. is finally disposed of with a direction to the Court below to decide the above mentioned case expeditiously in accordance with law without granting unnecessary adjournments to either of the parties.
