Heard learned counsel for the parties.

The record indicates that this Court by means of the order dated 11.07.2023, after hearing the parties found that it was a fit case for being referred for arbitration and had initially proposed the name of Hon'ble Mr. Justice Kamal Kishore (Retd.) Judge of this Court, however, he declined to accept the office to act as an Arbitrator and thereafter this Court by means of order dated 12.09.2023 had proposed the name of Hon'ble Mr. Justice Sanjay Harkauli (Retd.), Judge of this Court, R/o Flat No.- 912, F-8, Sagar Presidency, Sector- 50, Noida (U.P.), Mob. Nos.8004915450, 9821364609, Land Line No.-0120-4526972 to act as an arbitrator and had sought his consent.

The office report indicates that the consent has been received from the said Arbitrator.

Accordingly, in light of the order dated 12.09.2023, the Court appoints Hon'ble Mr. Justice Sanjay Harkauli (Retd.), Judge of this Court, R/o Flat No.- 912, F-8, Sagar Presidency, Sector- 50, Noida (U.P.), Mob. Nos.8004915450, 9821364609, Land Line No.-0120-4526972 to act as an Arbitrator, who shall enter into the reference and decide the same in accordance with law.
