The appeal is of the year 1990 and listed under the head that the case shall be adjourned.
The record indicates that on 17.03.2020, the matter is being repeatedly adjourned at the behest of the counsel for the appellants. On 04.10.2023, the Court had passed the following order which reads as under:-
"List this matter peremptorily on 16th of October, 2023.
It is made clear that no adjournment will be granted on the next date of listing as the appeal is of the year 1990."
Today again the counsel for the appellants is reported to be on sanctioned leave. The sanction leave is not be granted nor the same can be claimed as right in such matters which are old or listed peremptorily.
In view of the aforesaid, since there is none to press the appeal, it is accordingly dismissed for want of prosecution.
