Heard learned counsel for the petitioner and Sri Vinod Kumar Singh learned Additional Chief Standing Counsel.

Learned counsel for the petitioner is permitted to implead the M.P. Singh Smarak Vidhi Mahavidyalaya, Pachputi Jagatpur, Mankapur, district Gonda, through its Principal, as O.P. No.5 in the array of parties during the course of the day.

Learned counsel for the petitioner has submitted that the petitioner has passed 4th Semester LLB Examination and thereafter, he has to take admission in 5th Semester of LLB Courses and presently he is in Jail.

Learned counsel for the petitioner has further submitted that the petitioner may be allowed to submit his form before the College i.e., O.P. No.5 for which the Jail Authority concerned may be directed to send the petitioner in police custody to the College concerned only to submit his form.

Sri Vinod Kumar Singh learned Additional Chief Standing Counsel has opposed the prayer but could not dispute the aforesaid facts.

In view of the peculiar facts and circumstances of the case, I direct the authorities concerned to send the petitioner in police custody for one day only on 10.1.2023 for the purpose of submitting his form in the college concerned i.e., O.P. No.5. The petitioner will be taken back on the same date by the authorities concerned and he will be sent to Jail completing formalities on 10.1.2023 itself.

With the above directions, the writ petition is disposed of.
