Heard Sri Prabhakar Tiwari, Advocate, holding brief of Sri O.P. Tiwari, learned counsel for the revisionist and learned AGA for the State-respondent and perused the record.
This revision has been filed on behalf of the revisionist against the order dated 13.04.2022, passed by the Additional Sessions Judge, Court No.3, Unnao, in Session Trial No.396 of 2021, Case Crime No.784 of 2020 (State Vs. Deshraj & Others), under sections 364, 302, 201, 120-B, 34, IPC, Police Station Kotwali, District Unnao, by which the application dated 04.01.2022 bearing No.8-B moved by the prosecution for summoning and recording the statement of witness Anita daughter of Ganesh has been allowed.
Learned counsel for the revisionist stated that present revision has become infructuous, as the witness Anita daughter of Ganesh has been summoned and her statement has been recorded in the trial court concerned.
In the aforesaid circumstances, the revision is dismissed as infructuous.
