Learned counsel for the applicant submits that all these facts were placed before the court below, on which, preliminary inquiry was ordered by the then District & Sessions Judge, in which, the then concerning clerk has accepted that by mistake, it has been mentioned that supplementary case diary was also filed along with supplementary police report, in which, the charge sheet was filed against 3 persons, namely, Pancham, Ram Ujagar and Safiullah. In the said preliminary inquiry report, it is also mentioned that the report was sought from the concerning police station, wherein it was reported that in the Register No. 8, it is mentioned that supplementary charge sheet was filed against 5 accused persons, namely, Barsati, Chandrika, Bindu Lal, Keshav and Ramesh. Thereafter, the concerning clerk was exonerated by the Inquiry OfÏcer with the observation that it was a human error. Learned counsel for the applicant submits that the application was also placed before the court below, but the same was also rejected considering the inquiry report, which was conducted by Ms. Surabhi Verma, Civil Judge (Junior Division). Learned counsel for the applicant lastly submits that it is a case of interpolation in the record and, therefore, indulgence of this Court is necessary.
