Heard learned counsel for petitioner and learned State counsel appearing for opposite party No.1.
In view of order being passed, notice to opposite party No.2 stands dispensed with.
Petition under Article 227 of the Constitution of India has been filed seeking a direction to the court concerned for expeditious disposal of ADJ Case No.4/2018 filed by the petitioner under the relevant labour laws.
Learned counsel for petitioner submits that the aforesaid proceedings are pending consideration for the past five years wherein written statement has not been filed and evidence has not yet commenced. It is submitted that the proceedings merely summary in nature are required to be decided expeditiously particularly when it pertains to wages or outstanding thereof.
Considering the submissions advanced, the opposite party No.1-Presiding Officer, Labour Court, U.P., 23 A.P. Sen Road Lucknow is directed to decide the ADJ Case No.4/2018 (Alok Upadhyay vs. H.T. Media Limited) expeditiously preferably within a period of eight months from the date of a certified copy of this order is brought on record of the proceedings without granting any undue adjournment to either parties in case there is no legal impediment.
Benefit of this order shall be available only in case petitioner cooperates in early conclusion of the application/trial.
With the aforesaid direction, the petition stands disposed of.
