Heard learned counsel for petitioner.

In view of order being proposed to be passed, notices to opposite party no.1 stand dispensed with.

No one has put in appearance on behalf of opposite party no.2.

Petition under Article 227 of the Constitution of India has been filed for expeditious disposal of Case No.2586 of 2019 instituted by petitioner under Section 13(1) of Hindu Marriage Act.

It has been submitted that despite passing of more than four years from the date of institution of proceedings and although defendant has already put in appearance but even written statement has not been filed till date and since only general dates are being allocated in the matter, expedite orders are required to be passed.

It appears that earlier vide order dated 15.07.2022, parties had been referred to mediation which as per report dated 24.04.2023 has failed since no agreement was arrived at.

Considering submissions advanced by learned counsel for petitioner, opposite party no.1 i.e. Principal Judge, Family Court, Lucknow is directed to indicate a time frame for filing of written statement, failing which, appropriate orders may be passed.

Endavour shall be made to conclude proceedings of Case No.2586 of 2019; Vijay Kumar versus Snehlata expeditiously, preferably within a period of one year from the date time for filing written statement expires and in case there is no other legal impediment.

Benefit of this order shall be available only in case petitioner cooperates in early conclusion of the application/suit.

With the aforesaid direction, petition stands disposed of .
