Heard learned counsel for petitioner.

In view of order being proposed to be passed, notices to opposite parties stand dispensed with.

Petition under Article 227 of the Constitution of India has been filed for expeditious disposal of application for succession registered as Misc. Case No.168 of 2014 instituted by petitioner under Section 372 of Indian Succession Act.

It has been submitted that in the aforesaid proceedings, last opportunity was granted to the defendants to advance arguments on 23.01.2023 but since thereafter only general dates are being allocated in the matter, expedite orders are required to be passed since proceedings are pending consideration for the past almost nine years.

In view of submissions advanced by learned counsel for petitioner, opposite party no.1 i.e. Civil Judge (Senior Division), Pratapgarh is directed to decide Misc. Case No.168 of 2014; Bhanu Pratap Tiwari versus Harkhas and Ors. expeditiously, preferably within a period of one year from the date a certified copy of this order is brought on record of proceedings and in case there is no other legal impediment.

Benefit of this order shall be available only in case petitioner cooperates in early conclusion of the application/suit.

With the aforesaid direction, petition stands disposed of .
