Present petition has been filed with the following main prayer:-

" A writ, order or direction in the nature of Mandamus directing opposite parties to appoint petitioner as fair price shop keeper in Village Panchayat Nandupur, Post Fattaipur, Belabagh, Development Block Katehri, Tehsil Akbarpur, District Ambedkar Nagar, in the interest of justice."

Learned counsel for the petitioner has submitted that petitioner was selected for allotment of fair price shop in Village Panchayat Nandupur, Post Fattaipur, Belabagh, Development Block Katehri, Tehsil Akbarpur, District Ambedkar Nagar but till date no order has been passed in favour of the petitioner though the petitioner has made a representation dated 01.03.2023 to the respondent no. 4 i.e. Sub Divisional Magistrate, Tehsil Akbarpur, District Ambedkar Nagar, which is still pending.

After arguing at some length, learned counsel for the petitioner has confined his prayer to the extent that a direction may be issued to the respondent no. 4 to take a decision on the representation of the petitioner within a stipulated time frame as this Hon'ble Court may deem fit and proper.

Learned Standing Counsel has no objection to the prayer made by the learned counsel for the petitioner.

On the request of learned counsel for the petitioner, the present petition is hereby disposed of with a direction to the respondent no. 4 to take a decision on the representation of the petitioner dated 01.03.2023 in accordance with law within a period of three months from the date of production of certified copy of this order.
