The instant petition has been filed praying for a mandamus directing respondent nos. 2 and 3 to release payment of an amount of Rs. 1,06,73,745.00 along with 18% p.a. interest in lieu of works done under online Cloud Billing System by the petitioner's firm.
An affidavit has been filed by Gyan Prakash, Executive Engineer, Electricity Distribution Division-II, Basti stating that the payment of the amount due could not be made as accounts have to be reconciled. According to the respondent, the petitioner had submitted some bills again, in respect of which he had already received payment. He further submitted that as soon as the petitioner appears in the office, his account will be reconciled and payment will be released.
Counsel for the petitioner states that petitioner will appear before the Executive Engineer concerned in office on 18.07.2022 for the above purpose.
In case, the petitioner so appears, the Executive Engineer shall complete the exercise of reconciliation as assured by Sri C.S. Singh, learned counsel for the electricity department and the payment of the amount as may be found due upon reconciliation, shall be released within two weeks thereafter.
The petition stands disposed of accordingly.
