Learned counsel for the petitioner is permitted to implead Gram Panchayat, village-Sauraha Pargana- Sikandara, Tehsil-Phulpur, District-Allahabad as respondent no.12 during the course of the day.
The petitioner has preferred the present petition inter-alia with the following prayer:-
"(i) issue a writ order or direction in the nature of mandamus commanding and directing the respondent no.4 to ensure the implementation of the order dated 11.04.2013 passed by himself in Case No. 100/42 of 2011-12 forthwith."
Instructions were called for by this Court vide order dated 07.03.2022. Today when the matter is taken up, instructions received from the office of Sub-Divisional Magistrate, Phulpur, District Prayagraj dated 15.03.2022 is placed before this Court, the same is taken on record.
It is stated in the aforesaid instructions that against the aforesaid order Appeal No.1950 of 2018 Computer Case No.C201802000001950 (Tara Chand and Others vs. Salamat Ali and others) is pending before the Additional Commissioner, Prayagraj.
It is argued by the learned Standing Counsel that the Additional Commissioner will decide the matter, expeditiously.
Heard counsel for the parties.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned respondent to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
